Free Counseling, Budget Planning CONFIDENTIAL CALL: 455-5568 SPOKESMAN-REVIEW 41 Conflict of interest denied over grant HELENA (AP) Dr. Jerry Plunkett, the chairman of a state council which recommended a $100,000 state grant to a private organization which he himself heads, insisted to his fellow council members Thursday the arrangement reflects no conflict of interest.

Gov. Thomas Judge this week announced the grant by the Montana Department of Natural Resources to the Center of Innovation of Butte, operated by Plunkett. Plunkett is the department's Alternative Energy Advisory Council, which recommended the grant. In other matters at Thursday's council meeting, the group reviewed other grants, recommended two new ones, recommended changes agreement form the state signs with grant recipients and approved proposals to change the law governing the alternative renewable energy program. Though no one at the advisory council's meeting Thursday asked him specifically about possible conflict of interest, Plunkett volunteered a lengthy discussion on the subject.

He said his center will be the vehicle for attracting thousands of outside dollars to Montana for research and development of the so-called exotic forms of energy, such as solar and wind power. said that public money received by the center, except that needed to cover its own costs, will be "distributed for other projects." "I just refuse to believe there's any conflict of interest," Plunkett said. He said he accepted his post on the advisory council because the council is supposed to have members who are experts in the field of renewable energy resources. He said that to keep those in the field off the council would be like keeping farmers off agriculture boards. "There's a lot of interest, but no conflict," he said.

While members of the council are also experts in the renewable energy field, none of the others have requested and received funds handled by the council. Plunkett's grant, by far the largest of the 31 announced Tuesday, includes nearly onefourth of the $475,000 in grant money approved. The center expects to receive additional federal funds from the Old West Regional Commission and Energy Development grants from the National SciAdministration to matching ence Foundation, Plunkett said. Authority challenged on retirement debate HELENA (AP) Questions about the right of employers to force workers to retire at age 65 were argued Wednesday be state agency whose forthority to answer was challenged by the governor's office. Questioning the properness of the Montana Human Rights Commission hearing on issues raised by the American Civil Liberties Union was Robert Lohn, a staff attorney for Gov.

He also challenged the appropriateness of the type of forum being used by the fivemember commission headed by Elsie McGarvey of Kalispell. Lohn indicated a belief that the proceeding attended by some 25 persons in addition to the commission is not 1 in line with the Judge administefforts in behalf of ration's, public access to the decisionmaking process.

Rosemary Zion Great Falls, counsel for the Human Rights Division, countered that declaratory rulings are proper under the state Administrative Procedures Act and that they simply say how the law applies to a particular situation. Philip E. Roy of Browning, lawyer-member of the commission, said the agency has the power to interpret its own jurisdiction. Mrs. McGarvey said Lohn's objection would be considered later and allowed the hearing to proceed.

Russel Conklin of Great Falls, speaking for the ACLU, said he was startled by the Apology requested for remark HELENA (AP) The director of the Department of Institutions, Robert Mattson, owes "a full retraction and public apology" for his comments about the Mental Disabilities Board of Visitors, a legislator told him Thursday. "At best I find your comments a display of ignorance of the law in general and legislative intent in particular; at worst they are an arrogant demonstration of bureaucratic isolationism," Rep. Ann Mary Dussault, D- Missoula, told Mattson in a letter. Mattson, at a meeting of the Board of Institutions on Tuesday, aimed sharp criticism at the Board of Visitors, which issued its first report on warm Springs state mental hospital this summer. Mattson said the whole concept of the Board of Visitors was "ridiculous" and its allegations about Warm Springs were "poppyco*ck." Dussault referred Mattson to the state law establishing the Board of Visitors and spelling out its purpose and duties.

"Not only do you have the unmitigated gall to refer to this purpose as but you also seem to indicte that the board, carrying out the duties prescribed to it by law, is engaging in pure 'poppyco*ck, Dussault's letter said.
